Marino says he can’t release DOJ letter, as report indicates it doesn’t exist

Tom Marino’s story just got a lot harder to sell.

After being pressured for weeks by reporters, a radio host and his opponent, the former U.S. Attorney who’s running for Congress said Friday that he isn’t authorized to release a Department of Justice letter in which he claims he was given permission to serve as a reference for a businessman’s gaming application—even as his office was investigating the same businessman. But less than two hours after making that statement, The Associated Press reported that the letter might not even exist.

An anonymous Justice Department source told The AP that there’s no record of Marino ever having received permission to give DeNaples a reference. The report complicates what was already a dicey situation for Marino just 45 days before voters go to the poll in the 10th Congressional District.

Marino’s comments this week were his first on the controversy in months. At issue is the fact that Marino provided a reference for Louis DeNaples’ gaming application while his office was investigating DeNaples. Marino later represented DeNaples in private practice.

In April, he told a radio talk-show host Steve Corbett that he had permission from the Department of Justice to do so. His campaign manager said he’d release a letter documenting that fact.

But there’s been no release since then, Corbett has hammered Marino on the radio, Democratic incumbent Chris Carney has used the flap for TV fodder, and the Marino campaign has been mostly silent. Marino broke that silence this week, first in a vague statement Thursday and then again Friday.

“I have been in communication with the Department of Justice concerning the release of documents related to my service as United States Attorney for the Middle District of Pennsylvania,” Marino said Friday. “The Department of Justice General Council [sic] has informed me that these documents are confidential and are the property of the Department. The Department of Justice General Council explained that even though I am a former U.S. Attorney, I am bound by security and ethics provisions of federal law associated with my past service.

“While I am confident that the release of certain documents would end this matter,” Marino added, “I understand the sensitive nature of these documents and the important role that the Department of Justice has in keeping us safe. As a former U.S. Attorney, I will abide by the laws of this land and the polices of the Department of Justice, without question.”

It’s not exactly clear why it took Marino five months after he pledged to release the letter to finally say he can’t do so. His campaign spokesman did not return calls late Friday afternoon, and a Department of Justice spokesperson did not immediately return a call seeking comment.

Either way, Marino’s latest comments effectively amounted to a “trust me”—one that was quickly and severely undercut.

Carney’s campaign was quick to say Marino has “abused the public trust.”

The Associated Press made clear today that Tom Marino received absolutely no permission by the Department of Justice to serve as a reference for a convicted felon,” Carney spokesman Josh Drobnyk said in a statement. “It is now clear that Tom Marino lied about having been authorized to give the reference even as the felon was under investigation by Marino’s office. There was no letter showing that he had such authorization. What else is Tom Marino hiding? Tom Marino has abused the public trust at a time when ethics and character matter most.”

Clarification: This article originally implied incorrectly that Marino said during an April radio interview that he would release a Department of Justice letter showing he had permission to provide a reference for DeNaples. It was Marino’s campaign manager who said a letter would be released, not Marino himself.

Who Cares? Carney voted for Obamacare. This letter is the only thing Carney & the Dems have on Marino??? Give me a break!! Carney voted for healthcare which funds abortion. Alot of people do care about that. They care about the 500 plus billion that is cut in Medicare. They care about the fact they don’t have jobs. Healthcare costs are rising all thanks to Carney. It is not an issue to the voter. Carney could be running against Mickey Mouse & the Mouse will run. We are TIRED of CARNEY!!!!!!!

I bet the NRCC is wishing they had waited an extra day on their decision to throw away money into this race.

Correction: This letter is not an issue to the voter. Carney could be running against Mickey Mouse & Mickey would win. People are sick of CARNEY!

    Ada-

Once again, a partisan espousing the outlook: “Tom Marino may be a crook, but at least he isn’t a Democrat.”

That outlook is the reason judges who sell out kids can get nominated and elected.

  5. Mickey Mouse

    Sep 17th, 2010

Sorry Ada, I would never run against Carney. He’s done way too much for the 10th, and even in Disney World character and ethics matter–I guess it’s not the same in Marino World. Ada, you smell like cheese.

Tom Marino lied straight to the faces of the voters in the 10th district. How can we trust someone who lies to us. First, he yells at voters and now lies to them. He also attacked the congressman for going to be with his wife during her breast cancer procedure. Tom Marino is unbelievable. Tom Marino NO COMMON SENSE AND NO FAMILY VALUES.

  7. A Republican for Carney

    Sep 17th, 2010

I’m a lifelong Republican from Great Bend. I will be supporting Chris Carney 100%, so will my family and as many friends as I can tell. This article is proof of what many of us knew for a long time; Tom Marino is a corrupt liar who is only here for his personal gain. Mickey Mouse is dead on! Character and ethics matter; these are the values that are important to my family. Chris Carney, with the way that he handled all of those attacks, especially the one about his wife’s cancer, prove that in this race, there is only one man I can be proud to call my Congressman, and that is Chris Carney. If you read this sir, you have my vote!!!

Oh health care reform is worse than helping convicts as you investigate them? And then lying about it? THAT IS EXACTLY what’s wrong with the GOP. Awful logic as always.

SLAM!!!!! I believe that was the sound of a mousetrap closing on the most sensitive parts of Marino’s campaign’s anatomy and credibility.

    @KG

Best quip of the day (your paraphrase of Ada’s argument).

I picture a barroom with two groups of ex-athletes (in front of a lifesize photo of Marino) alternately chanting at each other: “Crook”, “Liar”, “Crook”, “Liar”, etc.

Get used to it, Ada. Chris Carney will be your Congressman another two years. He will be reelected because most voters don’t hate Democrats enough to vote for a candidate with direct connections to organized crime, who thinks that cutting Social Security benefits is a priority, and apparently has trouble telling the truth about something that is easy to track down. I heard that Marino is trying to get Palin to come and stump for him. Hmmmm. I wonder what she’ll say about all of this! Too bad Marino isn’t a “Mama Grizzly”.

  11. Former Dem

    Sep 18th, 2010

Ada, it is clear that you know nothing of the HC bill and just as bad as Marino. Thanks to you and Marino, Carney will be your Congressman again, so get over your nonsense and grow up. It is dumb uninformed people like you that is taking the country into the toilet. My family still left in the 10th CD will of course vote for a great man. who will you support, a great lying SOB such as Marino. You are one very sick chick !

The AP Article states – “A Justice Department source, who spoke on condition of anonymity to freely discuss the case, told The Associated Press there is no record of Marino having received the permission.”

An anonymous source and Steve Corbett had the audacity to say on his show that there was no letter. Whenever anyone would call his show with information that would absolutely refute his claims and would reference the source, he would never accept it as truth. Why is this different?

Re: Ada’s comment, she is absolutely right about Chris Carney. When he was asked at the Honesdale Town Hall Meeting about the Health Care Bill, he stated that he would NOT vote for it if abortion was included. Well he certainly did vote YES. He agreed to vote for it even before the President’s worthless Executive Order. So vis a vis, ABORTION IS COVERED IN THE HEALTH CARE BILL AND MR. CARNEY VOTED FOR IT!

As with the 7th district race that I facetiously suggested should simply be abolished last month to save us all from the lunacy of the supposed candidates running in that election, I’m thinking the same can now be said for the 10th district. Who do these folks think they are? They are simply not fit to run for any political office they are SO OUT OF TOUCH with the average taxpayer, NEVER putting their constituents ahead of themselves. It’s all about THEM. Abolish the 10th district as well, problem solved.

    Sep 18th, 2010

    Barb and Ada,

In case you’ve been under a rock for the last 40 years, abortion is a legal medical procedure, and you don’t get to decide who has one or doesn’t.

Should we begin to accommodate Christian Scientist belief, which is certainly every bit as legitimate as yours, and deny appendectomies with “government” money?

  15. Barb

    Sep 18th, 2010

    Karen,

If you don’t realize that an abortion ends the life of a child, I feel very sorry for you. Each child has special gifts endowed by God to make this world a better place. When even one child is abortted, our world is greatly diminished.

  16. Facts not Fiction

    Sep 18th, 2010

It is truly sad that there are voters who do nothing more than vote the party line. There are voters who believe any crap told, as long as it is repeated over and over.

There was no expansion of federal coverage of abortions due to the health care bill. There is no pro-choice candidate in the PA 10 race. The fact that some Republicans keep bringing this up as an issue if illustrative of their ignorance.

Carney is pro-life, as is Marino. Find an issue whaere there is a difference.

Try this one: Marino said he believes we need to do away with social security. Carney supports keeping social security solvent. Carney has my vote on that one.

  17. Barb

    Sep 18th, 2010

Chris Carney voted for the largest expansion of taxpayer-funded abortion in American history and has a clear 100 percent rating from two leading pro-abortion advocacy groups, NARAL and Planned Parenthood. He voted for this year’s Patient Protection and Affordable Care Act (PPACA), the health care bill which establishes taxpayer-funded abortion despite overwhelming opposition from voters.

  18. Mary Ann

    Sep 18th, 2010

Kevin, atheist or religious has no bearing on the scientific reality that the product of an abortion is a dead baby/foetus or whatever term you care to apply…. it is not a cancerous tumor or a diseased appendix that needs a medical procedure to excise it!!! No wonder the disrespect for life when we view a baby as such! Sad to say, the only reason that abortion is legal is that the specific medical and scientific information was at that time not available that showed the actual baby and it’s development. In fact the archaic measure of “Quickening”, as they termed it was used as a vague test of life… today scientific tests show brain waves, nerve reactions, heart beat at 21 days etc, and all earliest and later stages of the developmental progress needing only time and nutrition and protection from the abortionist to survive to birth. This is the solid evidence indicator that they were uninformed about the true nature of life. The law could not pass today. And is the basis for revisiting this issue.

@ Barb: You are an old goat beating the war drum over a dead issue. The GOP uses abortion to heard sheep like you into the voting both and pull the lever for them. When they had power they did nothing to change the status quo on abortion in this country because they know that when abortion is no longer an issue, sheep like you will have one less reason to come in from munching grass to vote Republican.

You know what makes me sick? I regularly dine with GOP operatives in Washington that openly admit that the GOP has no intention of moving on the issue whether they be in or out of power. A majority of them don’t give a rat’s tail about the issue other than its use in getting Republicans elected. They really have no problem with abortion either. They say things like, “Well, if you have a problem you better get it taken care of.”

  20. Barb

    Sep 20th, 2010

TB – Since you regularly dine with GOP Operatives in Washington, I guess you and they must have missed the following info.:

Pro-Life Accomplishment of the Bush Administration

    1. Appointed Chief Justice John Roberts and Justice Samuel Alito to the Supreme Court. The appointments resulted in the upholding of the federal partial-birth abortion ban by a 5-4 decision.
    2. Reinstituted the Mexico City Policy.
    3. Discouraged advancement of pro-abortion legislation by announcing early in his administration that he would veto legislation that threatened pro-life policy.
    4. Signed the Born-Alive Infant Protection Act.
    5. Signed the Partial-Birth Abortion Ban of 2003.
    6. Signed Unborn Victims of Violence Act.
    7. Cut off all federal funds to the United Nations Population Fund (UNFPA).
    8. Thwarted efforts at the United Nations to promote abortion.
    9. Issued Executive Order banning the use of new lines of embryonic stem cells in federally funded experiments. Later vetoed legislation passed by Congress to permit federal funding of embryonic stem cell research.
    10. Signed the Stem Cell Therapeutic and Research Act of 2005, which will fund research using umbilical cord and adult stem cells.
    11. Launched public awareness of adoption campaign.
    12. Established the first federal government and national website listing and showing children available for adoption across the country.
    13. Increased the tax credit for adoption related expenses from $5,000 to $10,000; for special needs children, the credit was raised from $5,000 for qualified adoption related expenses to $10,000 for any adoption related expenses. This was done as part of the President’s tax relief bill.
    14. Annually declared Sanctity of Human Life Day.
    15. Issued a federal regulation allowing states to include unborn children in the federal/state S-CHIP program,
    16. The Bush Administration did what it could to stop assisted suicide from taking further hold in Oregon.
    17. Signed legislation making it possible for a federal court to hear whether Terri Schiavo’s constitutional rights had been violated by being denied hydration and nutrition.
    18. Dramatically increased funding for abstinence education through the Department of Health and Human Services, although Congress did not approve the full amount the Bush Administration requested.

TB – I think you will also find the following very informative.

    Abortions in Military Hospitals

In 1988, President Reagan issued an Executive Order banning abortions at military hospitals worldwide, except in cases of rape, incest, or where the mother’s life was endangered. This ban continued until President Clinton revoked it with another Executive Order in one of his first acts as President. Two years later, Congress reinstituted the ban through a funding restriction in the Defense budget. This ban has remained in effect to this day despite repeated efforts by pro-aborts in Congress to provide funding for military hospital abortions or even to allow privately funded abortions in those hospitals. Should pro-aborts in Congress lift the ban, a pro-abortion president would not veto the move.

I just read this online yesterday – Presently, Senate Democrats are angling to end the military’s decades-old ban on allowing abortions in overseas military hospitals, thus thrusting the culture wars back onto the front burner after months of being drowned out by the nation’s economic woes.

Sen. Roland W. Burris, Illinois Democrat, ushered the proposal through the Senate Armed Services Committee in May, tacking it onto the Defense Authorization Act, which the Senate is slated to consider Tuesday.

Accomplishments? Answer one question for me Barb: Are abortions still performed in this country? After all your mission is to put an end to abortion, is it not?

Answer another one Barb: How many times was capital punishment carried out in the state of Texas while your pro-life hero, George W. Bush was Governor?

Good for the Bush Administration; they threw some dogs like you a few bones to keep you around to vote in the next election. Did they put an end to abortion? No. Did you keep voting for them? Yes.

  23. Barb

    Sep 21st, 2010

    TB,

My mission is defending the life of the defenseless, what is your mission?

President Bush was working diligently toward the end of abolishing abortion in this country. He appointed two Supreme Court Justices and one more was needed to end this barbaric procedure. Not until the present pro-abortion president is voted out in 2012, will that opportunity present itself again. God-Willing, we will then have a vacancy on the Court and a Pro-Life President will appoint a conservative judge.

  24. TB

    Sep 21st, 2010

Barb, before you start asking me questions, answer my question to you. How many times was capital punishment carried out while George W. Bush was governor of Texas? Does capital punishment promote life?

What is my mission? Elect Democrats. I hold pro-life values but I refuse to cast a vote for a candidate based on that issue alone. As a Roman Catholic I believe the Democratic Party, with the sole exception of the abortion issue, follows the Catholic social teaching as spelled out in the Corporal Works of Mercy extremely well. While the Republican Party has obsessed over promoting institutions of death such as the Department of Defense and the military industrial complex, protecting Wall Street, and protecting the oil industry the Democratic Party has been busy feeding the hungry, giving drink to the thirsty, fighting to protect middle class Americans from Wall Street, creating student loan programs so every American has the opportunity to attend college, and working toward an America where every American has affordable health insurance(including pregnant women and unborn children).

  25. Barb

    Sep 22nd, 2010

    TB,

You said, “As a Roman Catholic I believe the Democratic Party, with the sole exception of the abortion issue, follows the Catholic social teaching as spelled out in the Corporal Works of Mercy extremely well.” The most important issue is life because without life, nothing else matters.

I think you need to put this statement on your mirror and repeat it over and over every day – YOU CAN’T BE CATHOLIC AND PRO-ABORTION. What part of this statement don’t you understand?

  26. TB

    Sep 22nd, 2010

I never said I was you old bat. Go back and read what I wrote. I never once said I was pro-choice.

  27. Barb

    Sep 22nd, 2010

    TB,

Watch the name calling – so far you’ve called me an old goat, a sheep and an old bat. You’re a typical liberal Democrat.

Let me get this straight, your mission is to elect Democrats and you believe the Democratic Party follows the Corporal Works of Mercy, with the one exception being the abortion issue. Therefore, I surmise you vote Democrat. The Democratic Party is 100% Pro-Abortion, vis a vis. you’re Pro-Abortion. It’s that simple, now you know.

  28. TB

    Sep 22nd, 2010

Don’t misconstrue my stance on an issue Barb. Unlike you I’m not a one issue voter. You probably don’t know jack about anything other than this one lousy issue.

  29. Barb

    Sep 23rd, 2010

    TB,

Don’t misconstrue my stance on an issue TB. I am well versed on all issues and there are many that are very important to me. But everyone has one issue that is the most important to them and mine is Pro-Life. If a person says that they don’t have one issue that is paramount to them, that person is a liar.

What has Carney donme that is so great for tis district?
I get his email newsletters every week and can’t see where he’s done anything by his own statements.
What has he done on the gas drilling drinking water situation? Nothing that I can see, while Senator Casey has been working on it.
Carney is dirty campaigner and will use anything he can twist to get reelected.
as for DeNaples “having direct ties to organized crime” you better be careful over such statements, as there is no evidence of such, despite the feds attempts to find any.
