Burns cries foul over spending by a Critz ally

Wealthy GOP businessman Mark Pasquerilla made waves earlier this year when he backed Democrat Mark Critz over fellow Republican—and fellow millionaire—Tim Burns in the 12th District special election. Now, three months before now-Congressman Critz and Burns square off in a November rematch, Burns’ campaign is taking issue with the way Pasquerilla has spent his own money to boost Critz’s political prospects, charging that both men are effectively circumventing campaign finance laws.

Pasquerilla has already given Critz’s campaign $7,200, the maximum amount allowed for individual contributions ($2,400 each for the primary, special and general elections). But at issue for Burns’ campaign are two newspaper ads Pasquerilla has taken out in The Tribune Democrat on his own dime. One ran shortly before the May special election, and urged voters to cast their ballots for Critz. The other ran earlier this month in response to an item on Burns’ campaign Web site.

Both ads carried the disclaimer that they were paid for by Pasquerilla personally and were “not authorized by any candidate or campaign committee.” If Pasquerilla purchased them as an individual without coordinating with the Critz campaign, the ads would seem to amount to protected free speech. But Burns’ campaign is arguing that Pasquerilla is too close to the Critz campaign to make that claim, and that the ads effectively put Pasquerilla over the legal contribution limit. In an interview with pa2010.com, Burns spokesman Kent Gates said it was further evidence that Critz is playing loose with election laws. He noted that Critz received a warning from the Cambria County Elections Supervisor for allegedly going into polling places on election day.

“I’ve personally never been to a Critz campaign event that Mark Pasquerilla has not also attended,” Gates said. “We know he has a leadership position within that campaign, and to say that he did not coordinate that ad is just not feasible. He’s not just a donor.”

In an e-mail, Pasquerilla denied any impropriety.

“I know it may be surprising to the Burns consultants that anyone from the 12th District is capable of writing a strong persuasive argument, defending the area’s work force or otherwise, but I take full credit,” Pasquerilla said. “The ad was not out-sourced, it is my creation. I do think if they pursue this complaint, that they may be trying to muzzle me and limit my constitutional rights of free speech.”

Gates also criticized the Critz campaign for holding debt to Pasquerilla’s Crown American Corporation, money he thinks should also count towards the businessman’s contributions. The Critz campaign held their election-night victory party at Pasquerilla’s Johnstown Holiday Inn, and had not paid the bill as of the recent June 30 reporting deadline.

“In all my experiences in politics, I’ve never seen a campaign not pay up front for a victory party,” Gates said. “All of these favors and donations from Mark should be counted, he is not acting in an independent way. The fact of the matter is that Mark Critz is willing to break the law.”

Critz campaign manager Mike Mikus said the Critz campaign has since paid off all but $1,200 of the debt owed to Crown American.

“We can’t use money coming in for the general election to pay off debts from the special,” Mikus said. “We’ve got to wait for a donor to step up and dedicate their money to debt retirement, that’s the only reason we’re holding off, it’s not a favor from Mark.”

It remains to be seen if Burns’ campaign will file a formal complaint with the Federal Election Commission. The general election rematch is currently No. 8 on the pa2010.com Congressional Power Rankings.

    There’s no question that Critz is ethically challenged, he has quite a track record of unethical behavior when you look to Parkins and the 12th special election selection. Thats quite obvious, but fortunately for us, win or lose, his time will come to an end soon and he will be irrelevant.

    They are circumventing the campaign finance laws, or atleast it would appear so to anyone above a 5th grade education. Im curious what Pasquerilla is getting out of this? Has anyone looked into that? Certainly a fair question.

    I thought that the GOP members of the US Senate just voted to block limits on corporate and individual spending for elections. What is the philosophical position of the Burns team on campaign finance? Mark Pasquerilla is a member of the GOP. The Supreme Court has held that money is speech. It seems to me that he is being consistent with his philosophy to spend his own money to address important issues.
    Indeed, the GOP candidates across the country are being bolstered by the engagement in speech of private citizens and corporations in our democratic process.
    Mr. Gates’ other client in the Nevada Senate race, for instance, has been getting tons of print and broadcast commentary help from members of her inner circle in her fight against Harry Reid. Will Mr. Gates file a complaint against his own candidate? I think not.

    Seriously, Burns is literally crying over two newspaper ads by an individual in one part of the district??!! What a baby! Like a $1000 ad is the reason he can’t beat Critz! This is one of the worst run Congressional campaigns I have seen in a while.

    Let’s attack a guy who we’re not running against and who isn’t on the ballot. Smart thinking Burns.

    I don’t believe that you can blame Burns. He is a neophyte who got sold a bill of goods by some slicksters who are not movement conservatives but merely prey on them. The Colonel was a true conservative and the party leaders should have rallied to him and his Tea Party principles. Instead, they duped this naive rich man into running in order to fleece him like a penned up ewe.

    Dan and John: Thanks for bringing light to my ad. The ad came about because an important economic development agency is running a $100k marketing campaign on the region’s work force, while the Burns site calls us lazy good for nothings. This was too much for to to stomach. Obviously, the Burns whining is a distraction. Disrespecting area workers is probably a tactical mistake that they don’t want highlighted. I do believe Burns owes the workers of the 12th district a major apology. I am even willing to pay for the Burns apology to area workers in a like-sized ad. Again, PA2010 gang, your site is very important to political dialog in the Commonwealth. And MR BURNS. PLEASE APOLOGIZE!!

    We have some Mark Critz resume economic development pictures we want you to take a look at…. shutdown abandoned small businesses, sometimes whole streets throughout the 12th, these are of course outside the luxury suite of your hotel.

    Of course, all this happened while the big job creator, Mark Critz, was economic development director. Critz is out to save one job… his own.

    Why is such a campaign necessary? Because the business environment in PA is horrible, and it is made worse by the kinds of pork spending, central planning, and corporate welfare once championed by Murtha, now Critz, and apparently Pasquerilla.

    The best thing the 12th district can do for itself is bounce Critz from his seat and turn the page on the corporate welfare regime.

    I’m incredulous that Burns, so vehemently loyal to his party, is questioning the legality of unlimited corporate donations to a campaign. Even if Critz is “ethically challenged,” as WESTPADEM6 said, he certainly doesn’t seem to be breaking any rules recently mandated by the Supreme Court regarding campaign finance.

    Dear Mr. Collins: This JARI campaign is championing the work ethic of the area. We are sick and tired of hearing about Candidate Tim Burns as our Saviour. He is has been MIA in the area, he head-quartered his business outside the district and he has done absolutely 0 for us. We have do have successful entrepeneurs like Bill Polacheck of JWF Industries who is very active in our area. He started his business from his garage but never forgot his working class roots. By the way what is wrong with Government contracting? Ross Perot built his business EDS as a contractor and we all love him. No, Candidate Tim Burns owes our area an apology.

    Lots of places have workers who are well educated and have, by some subjective assessment, a good work ethic. Not all of them have to beg for jobs.

    Empirically speaking, the corporate welfare model has failed in the 12th district as it has elsewhere. Time for a different plan.

    Nothing is inherently wrong with government contracting — the government has legitimate purposes and needs — but it’s not a sustainable plan for job creation. Bloating the government sector through earmarks and pork is a negative sum game.

    Dear Mark Pasquerilla: What are you getting in return for sleeping in bed with Mark Critz?

    I hope you know that this earmarking B.S. will die out sooner or later. Look at Rangel, and rumor has it Maxine Waters is next. Pay to Play does not work forever, Rangel was in for 50 years, and now he has to leave in disgrace. Sooner or later, this pay-to-play business will catch up with all lawmakers. The real question is, what will they do when public financed elections will go into effect? Guess that means these lazy politicians would actually have to listen and be nice to their constituents and earn every vote, not buy it.

    I love to hear Mark Pasquerilla talk about loving Johnstown, being a business, and criticizing Tim Burns for not starting his business here. Mr. Pasquerilla proudly sold out his hometown by closing operations here and sending 300 jobs down south. Do democrats (yes, Mark, you are a democrat) ever consider their own blatent hypocrisy?? No one individual has caused more job losses in Johnstown than Mark Pasquerilla. Must be comforting for Mark Critz to have as one of his economic advisors the guy that single handedly destroyed the Crown American empire.

    I ended up here while researching area Republicans for a possible interview I am looking to set up, I’m comparing todays GOP to the days of Teddy Roosevelt. I was thinking of asking Mr. Pasquerilla. But after seeing this site and who he is backing, I might need to look elsewhere. Where are all of the real Republicans these days?
