Dems hit Corbett over health care suit

The state Democratic Party on Tuesday criticized Attorney General Tom Corbett for threatening to sue the federal government over newly-passed health care legislation, charging that Corbett is using the power of his office to aid his gubernatatorial aspirations.

“It is wrong for Candidate Corbett to use the office of Attorney General for his thinly veiled political posturing on critical health care reform,” party chairman T.J. Rooney said in a statement. What’s worse, in bringing Pennsylvania into this ridiculous lawsuit, Corbett is siding with big insurance over people with preexisting conditions and the hundreds of thousands of Pennsylvanians who will receive health care as a result of this legislation.

“Pennsylvanians deserve a leader who stands up for working people,” Rooney added. “Corbett’s actions yesterday prove that he is far more concerned with raising the profile of his political candidacy than doing the right thing for Pennsylvania families.”

Corbett’s office said he’d pursue legal action in a brief statement Monday. As The Daily News noted, a legislative measure that was initially targeted by Republican attorneys general for suit has since been removed from the bill, and Corbett’s office has not yet said precisely on what grounds it will challenge the legislation.

    This could be the move that sinks Corbett’s campaign. If all of the Pennsylvanians that voted for Barack Obama’s agenda come out and vote in the gubernatorial campaign, they (we) will vote against an AG who wants to turn back the progress that was made in healthcare reform.

    The suit would cost Pennsylvania $950 million. Where is he going to raise taxes to offset that enormous sum in the budget?

    It will not cost $950 million to file the case. Most of the people who will handle the case are internal staffers that are on a salary. Also the several states will be joining so the breif research is shared. Since it is a Constitution argument there is no discovery costs. So not sure where you see almost a billion dollars being spent. Can you site the source for the cost to sue the government. Let me guess a policial add, a robo call from a special interest group, or somewhere on the internet.
    The AG is in place to protect the interest of the states and the people. With this bill the federal government will be asking the state of PA to pay more money to health care that the PA house did not vote or approve. So for this reason I want an AG that will stand up and tell the federal government that the state of PA will not accept a federal governmnet coming in and spending money that the state congress or senate did not approve.

    This Healthcare Bill is unconstitutional and General Corbett should be applauded for not only defending the people of Pennsylvania but the entire country by fighting to uphold the constitution. For all you liberals and progressives, it is spelled C-O-N-S-T-I-T-U-T-I-O-N. Look it up!

    Have you Wingnuts ever read the Constitution? You seem to have read the 10th Amendment, but for some reason you ignore the Constitution. Read the preamble, and Article 1 section 8. The federal government has the power to provide for the general welfare. It is delegated to the Federal government, so the 10th Amendment does not apply.

    Pa. is going broke, time, energy and resources have to be spent on fixing the state’s problems such as pension reform, how to fund all of the transportation needs, the fixing of bridges and roadways, keeping an eye on the drilling of shale, making sure the state politicians do not continue to use taxpayer money as personal piggy banks etc. The Healthcare Reform bill is now LAW, IT IS NOT UNCONSTITUTIONAL (please read the constitution carefully before making such remarks. As the current AG stop already with this nonsense and concentrate on the business of serving Pa. taxpayers. If you can’t do the job you were elected to do, or the job you are seeking, simple advice Tom Corbett: please just go away once and for all. We need true leaders in this state to lead, not the same old bureaucratic efforts, which in this case is strictly grandstanding as a gov. candidate. Enough already, we need to CHANGE THE CULTURE in this state.

    Hey Pete a few points:
    1) the Preamble is a statement of what the Constitution hopes to provide. Kinda like the mission statement of the document. There is no stated law there.
    2) Even if you are going to think of it as a specific law it states that the federal government is going to provide these things. They cannot make financial commitments and then turn to the states and tell them they are going to have to pay for it. Think about with welfare reform and schip. The states had to incorporate the changes into their own state laws. It was not the federal government making a decision and then turning to the states to pay for it without it being approved by the states. So this is the reason where this goes over the line and violates the states rights section of the Constitution.

    Liberals want this, so it’s a civil rights issue. Just like gay marriage, that’s a civil rights issue too. And amnesty for illegals, that’s a civil rights issue. With increasing the number of people on Medicaid is only going to take away from sate money that can be spent on infrastructure, schools, and pensions. So you are basically making the argument why the state of PA should oppose this law. We cannot afford it as a state. It will be a drain on the state budget that will take away from the things you want fixed in the state. See why this is out of line and why Govs around the country are getting upset about this.

    The healthcare bill requires everybody to be covered by healthcare or face fines or jail time if the fines are not paid. The Federal Government feels this is constitutional through their powers to regulate interstate commerce.

    One of the arguments in the states’ lawsuit is that this section of the bill is unconstitutional because it punishes people for inactivity. As the lawsuit says, “inactivity by its very nature cannot be deemed to be in commerce.”

    The other part of the lawsuit relates to the increase cost of the states managing of Medicaid. In short, the states claim that they will never be able to afford the increase without substantially raising taxes. The Federal Government does kick in some money, but not enough to help offset the enormous increase.

    If you like taxes and living in poverty, you will love the bill just signed into law today. Enjoy leaving your shanty for a “free” visit to the doctor. Then you get to go home and starve due to a lack of money to buy food.

    Kevin – the Supreme Court has ruled time and time again that inactivity can affect interstate commerce. Even Scalia has come out in favor of precedent on this issue. The inactivity in this case could lead to an inability to pay medical bills when someone without insurance gets injured or sick, which causes those costs to get passed onto the rest of us. This bill seeks to eliminate economic inefficiencies and market failures to reduce costs overall and improve the efficiency of the health insurance industry while simultaneously increasing access to affordable, quality health care to nearly all Americans.

    This is not a government takeover – that’s Republican talking point garbage. This is regulation. It can be used to hinder industries or it can be used to improve efficiency.

    If you like being a selfish jerk who doesn’t actually know what he’s talking about, then you’ll hate this bill signed into law today. See – I can make completely ridiculous blanket statements too! Isn’t it fun?!

    I hate Insurance companies, I hate BIG Business, I hate Banks, and I hate Attorneys and Politicians. That said… I have pre-existing conditions, chronic illness, in early 60′s, and lower middle class. So, as a disabled/retired RN that puts me in the barrel that will undoubtedly be with-held treatment soon. Finally I will get the same treatment my Dog has been afforded! Yippee, skippee!

    Bad analogy. The auto-insurance law doesn’t effect non-drivers.

    Better examples are taxes for fire fighters(even if your house isn’t on fire at the moment), police (even if you aren’t being robbed) and schools (even if you don’t have kids).

    Interesting, we are told the Democrats pushed this law against the will of the people. I remember Health Care Reform as one of President Obama’s main campaign issues and he was elected based on that platform. He actually was morally obligated to fight for Health Care Reform just as he promised us. Millions of Americans elected the president and we do not need to be saved by Corbett. Latest polls say that the majority of Americans support this reform. Wake up!

    Isn’t Corbett doing the very same thing that he’s prosecuting others for doing? I.e., using taxpayers money to file a lawsuit that is at best frivolous and at worst against the best interests of Pennsylvania citizens and doing it solely to enhance his political campaign? Is this grounds for impeachment?

    Lee, it is at least grounds for a citizen’s arrest because the chief law enforcement officer of the Commonwealth is using taxpayer money and government employees to advance his political career. I would think that the General Assembly could subpoena his phone, email and written records to see if this lawsuit was discussed with his GOP consultants who (I see) were quoted about this extensively in some publications.

    Jeff, I DID NOT make the argument of why trhis bill is bad for the state, you are only looking at the cost side, forgetting the savings side of this bill. This will aid the CHIP program in Pa. and the cost of buying pharmaceuticals. Tom Corbett is simply wasting time, money, energy and resources on this suit. Enough already, Mr. Corbett, please just go away once you finish your term as AG. We don’t want the same old, same old even thinking of being governor in this state.

    I also hate big business. What ever happened to the Mom & Pop business’s the I and my children grew up on. The small business person is slowly being forced out of business. I due to auto accidents none of which were my fault and now MS am forced to be in a wheelchair all the time. I take a lot of medication along with injections. I require a special vehicle for driving and if it weren’t for my friends having a fund raiser I wouldn’t have that. I also have a service dog. My point is I am unable to get into a lot of stores to shop, and when I park my van despite the sign on the window that says please allow extra space for loading and unloading, it seems no one pays attention to it. Some may allow for the ramp to drop but then there is no extra room for my wheelchair to exit the ramp. Another major problem at the weight of opening several doors to gain entrance to a store alone with the fact that many only have steps, which means there is no way I am able to get into their place of business. I also live in the generation where woman were able to stay home with their children, which has extremely limited my Social Security income. You try to maintain a home and some type of life on an income well under $600.00 a month and purchase the medical equipment you need also. Do go needing the ramp for entrance really restricts entrance to many places, and having to use Medicare,and Medicade and Access are very embarrassing and humiliating as I was brought up to do anything you could to survive on your own. Do to a blood clotting problem I have, along with MS and many other conditions that require me to be in a wheelchair. Therefore life isn’t easy but I try to do the best I can. Life is tough enough, and becomes even more difficult when you are trying to find a doctor that will accept the only medical insurance you have, along with obtaining prescription, as you are usually given the generic medicine and my blood thinner won’t allow it. When I say the medical coverage that the government officials will receive plus their spouses I almost lost it. Do you have any idea how long it would take me to equal that type of money with my Social Security ??? If they received what I receive we could have coverage for so many more people. It’s terrible, as government employees aren’t any better than the rest of us. The government wasn’t formed to make sure their buns are covered, it’s suppose to be for the people by the people, not the privileged few that happened to express enough bull to get them elected. My service dog gets better treatment than I do!!
